Dear Panelist,


Further to our last update on the execution of the exit policy. we wish to inform our SpeakAsia community that we have finished analyzing the results of the first test batch of payouts that were sent.


We have identified certain roadblocks such as multiple claimants to the same panelist id or bank details not matching with the ones submitted at the time of applying for the exit policy, because of which not everyone got the remittance in their accounts.


We are at this moment addressing those issues and hope to have a resolution to them by the end of this month. Once we have the resolutions in place we will then send out a second batch of test payouts. On successful completion of this second batch we will commence the payout as per the exit policy.

We understand that there are delays in the process. One of the main contributor to this delay is the fact that we have had to do all the transactions and checking manually as our old automated systems are still under the custody of EOW Mumbai Police. We appeal to all the SpeakAsians to remain patient and bear with us as we work feverishly towards attaining our goals.

New Delhi: The Corporate Affairs Ministry has indicated that completion of the probe into alleged scam at SpeakAsia could take more time due to legal hurdles.

The Serious Fraud Investigation Office (SFIO), under the Ministry, is probing the alleged irregularities at Singapore- based multi-level marketing company SpeakAsia.

In response to a Right to Information (RTI) query on the issue, the Ministry said the time frame for completing the SpeakAsia probe is yet to be quantified.

"Investigations into the affairs of the company SpeakAsia Online Pvt Ltd is not yet complete and due to various legal issues involved in conducting investigation of a foreign company having operations in India, the time frame for completion has not been quantified," the Ministry has said.

As of now, there is no clarity on whether it has the powers to probe irregularities of a company, which is registered overseas, but has operations in India as well.

The investigation agency is awaiting clarifications on the issue from the Corporate Affairs and Law Ministries.

SFIO, set up to probe corporate frauds under the provisions of Companies Act, began investigations into SpeakAsia after an alleged scam came to light early last year.

The agency takes up only those cases that are referred by the Corporate Affairs Ministry.

Under the existing Companies Act, there is no clarity on whether Indian authorities have powers to probe an overseas entity having operations in the country. However, this issue has been addressed in the new Companies Bill, which is likely to be discussed in the Parliament soon.

In the new Companies Bill, clause 228 provide powers for authorities to look into affairs of overseas companies having operations in India.

As per the Bill, "This is a new clause and seeks to provide that the provisions relating inspection or investigation under Chapter XIV shall also apply mutatis mutandis to inspection or investigation of foreign companies".

Chapter XIV is related to inspection, inquiry and investigation of companies.

According to its website, SpeakAsia is not registered as a company in India as it is not a permanent establishment (PE) here.

Processing of the Exit Option

Dear SpeakAsians,
As per the recent Order passed by the Hon’ble Supreme Court, the mediation proceedings have come to an end. However, SpeakAsia continues to stand by its commitment for releasing the payment to its panelists. It is therefore putting in motion the execution of its exit policy and as an initial step, SpeakAsia will be executing the payouts for a test batch of panelists.
This exercise should take a couple of weeks as confirmation e-mails would be sent first to those panelists and then the amounts would be transferred upon receipt of confirmation. After successful execution of the test batch, we will initiate the rest of the payout based on the data available with us as per the exit option. Should we face any difficulties in executing the payouts, we will then approach the concerned authorities to seek remedial solutions. We will also keep all of you posted on the developments as it happens.

As per the information available all the things are positive, nothing is negative. In fact nothing could be negative about Speakasia case because none of the allegations imposed on it has been proven till date. So, the same practice has been continued in the yesterday’s hearing as well. It is an appeal to the most prestigious family of SpeakAsians not to indulge in any type of rumor because our enemies always try to misguide and demoralize us. I repeat not to believe in any rumor because none of the information has been validated till now.

As informed in the Update Hon’ble Mr. Justice Dipak Mishra is sitting on a five Judge Constitutional Bench along with the Chief Justice.

One year after the crackdown on Speak Asia, more than 20 lakh investors are not sure whether the company will refund their money.

A little over a year ago, Jodhpur-based Ritu Bhayal was bubbling with enthusiasm. Within 4-5 months of chucking her job with an insurance company and joining Speak Asia, she was making good money by answering online surveys and enrolling new investors. "I earned about Rs 54,000 from an investment of Rs 33,000. Selling insurance was tougher than enrolling investors to conduct surveys," she says.
However, the stream of income dried up when the authorities cracked down on Speak Asia in June 2011. Top officials were arrested on charges of fraud and the company stopped its operations. Bhayal now runs a school in Jodhpur and hopes that the good times will return once the cases pending against Speak Asia are disposed of and the company resumes operations. 

 Ghaziabad-based government school teacher Sudhir Sharma is another optimist. An early mover, he made almost Rs 2 lakh from an investment of Rs 33,000 in Speak Asia. However, Delhi-based Ashok Vishwakarma is not so hopeful. A late entrant to the Speak Asia pyramid, this 40-year-old has not earned a rupee from the Rs 33,000 he put in the company in February 2011. "I invested the amount initially and earned about Rs 9,000 in two months. Then greed got the better of me and I bought another survey panel for Rs 11,000 in late April," he says. Vishwakarma is more worried about facing his colleagues, who invested Rs 44,000 in Speak Asia on his advice.

Good Evening Speakasians,

The WP 383/2011 in the Hon. Supreme Court was adjourned to tomorrow (10th May, 2012) and the Hon’ble Supreme Court has taken a serious view of the delay due to the non filing of Affidavits by the EOW and the CBDT (Income Tax). The Hon’ble Supreme Court has asked both the Departments to file their affidavits by tomorrow.

Our dear friend Mr. Navniit Kkhosla was also present in the Court pressing for his intervention, I think this is in gross violation of the affidavit filed by him in the Hon’ble Bombay High Court where he has sworn that he has received the entire dues to his entire satisfaction, he has further sworn that the he will help the company in getting the FIR withdrawn, contrary to this he is going to the Supreme Court to press his intervention only to the delay the matter further. The Hon’ble Justice even asked him what he will achieve by delaying the matter especially when the Company has come forward to pay off the Panelists.

The matter has been adjourned to tomorrow and we must all remain patient with a positive bent of mind in view of the positive stance of the Hon’ble court in our favour.

In the WP/ 3210 and 3211 in the Bombay High Court the matter did not reach the listing and we will get to know of the next computer generated date within a day or two.

1. Exit Option Launched - 1 August, 2011. yahan se pata chal ki company paisa dena chahti hai...!!

2. Mediator Appointed - 14th November, 2011. Hon supreme court ne maana ki yeh ek vivaad hai aur isey aapsa baatcheet se suljhaya jaana chahiye... jiske liye lahoti sir ko mediator appoint kiya gaya..!!

3. Amount Deposited - 20th Feb, 2012. Company ne 50 crore ( DD no. 037002, State Bank Of India, Singapore Branch) Supreme Court Registry me deposit kiye..!!

4. Stay on investigation - 21st March, 2012. Navneet khosla ne apni complaint wapas li aur uski wajah se ho rahi investigation aur arrests par stay laga.

5. Saol is not an Indian Company - ab isme aisa hai ki company indian nahi hai... jab writ 383/2011 in Supreme Court me usey party banaya gaya to usko reply dena zaruri nahi tha kyunki saol Indian Jurisdiction me nahi aati... lekin SpeakAsia ne wahan reply diya aur 50 crore deposit bhi kar diye..!! yeh hai uski imandari aur naitikta ka saboot..!!

To agar koi bhi bhai company ke against ya apne upline/leader ya kisi bhi tarah se SpeakAsia se related kisi bhi person ke against F.I.R ya complaint karta hai to uska koi use nahi hai..!!! Aaj bahut lamba safar karke hum yahan tak pahunche hain... ab koi galti mat kar baithna... jis se ki baad me pachtaana pade...!!! kyunki ye sawaal 12.5 lakh logon ki rozi roti ka hai... kisi bhi tarah ka delay aisi galti ki wajah nahi hona chahiye... 12.5 lakh logon ki duwa aur bad duwa dono he khali nahi jayengi..!!! Pasand aapki kyunki zindagi hai aapki...!!!

As you are all aware that the company has been actively 

engaged in solving the current crises that it faces for the 

last eleven months. This journey has been long and tough and 

has brought out the best effort from all of us in combating

• Dear friends,
  SAOL Management has taken various steps from day one for the benefit of the panelists and kept speak asian family well informed about all progress.

May 2011 :  Speak Asia did a press conference to explain their business model.

June 2011 : Wrote to ministries and RBI for business model presentation.

July 20011 : Given presentation to RBI.

August  2011 : Announced exit option.

September 2011 : Won the WRIT filed against RBI to change the circular which has taken speak asia name.

November 2011 : Filed an affidavit in supreme court of its intention to pay its panelists opting for exit option and for business restart.

January 2012 : Given an affidavit to Mr. Lahoti committee appointed by supreme court as mediator an affidavit to clear all dues of panelists and government agencies.

February 2012 : Deposited Rs. 50 crores with supreme court registry as surety with an affidavit to bring in more funds if required to pay dues.

March 2012 : Requested for website to ascertain dues and start payment process.

April 2012 : SAOL management is approaching to various agencies like ROC, MCA and all legal formalities are in process for PE in background.

Few points I like to convey you all my fellow Speak Asians :

1. Company will not go anywhere now that is confirm , so be confident and faithful towards our esteem company SpeakAsia Online (refer to last two updates of company on its marketing blog in speakasiamarketing.blogspot.com)

2. SC proceedings will give direction to the further cases of SAOL i.e; Mumbai & AP accordingly
